Privacy policy

This Privacy Statement explains what personal data (information) we hold about you, how we collect it, and how we use it. We are required to notify you of this information under data protection legislation. Please ensure that you read this notice (sometimes referred to as a ‘privacy notice’) and any other similar notice we may provide to you from time to time when we collect or process personal information about you.

Who collects the information

The EU General Data Protection Regulation (”GDPR”) entered into force throughout the European Union on 25th May 2018 and brings with it the most significant changes to data protection law in two decades. Based on privacy by design and taking a risk-based approach, the GDPR has been designed to meet the requirements of the digital age, Cross Border Talents, with headquarters at Cais da Rocha Conde d’Óbidos, Edifício LACS, 1350-352 Lisboa, Portugal, henceforth identified as ”CBT”. In this notice, references to ‘we’ or ‘us’ mean Cross Border Talents and our group companies.

Data protection principles

We are committed to ensure the security and protection of the personal information that we process, and to provide a compliant and consistent approach to data protection. We have always had a robust and effective data protection program in place, which complies with existing law and we will comply with the data protection principles when gathering and using personal information. We seek to ensure that our information collection and processing is always proportionate. We will notify you of any changes to information we collect or to the purposes for which we collect and process it.

Personal data provided at the user’s initiative

CBT may, in some cases, request personal data from website users for the following purposes:

  • Candidates who register with us for roles that we are managing for other employers, or through our website, social media sites or other sources;
  • Prospective candidates;
  • Assessing collaboration proposals.

Navigation on the website does not imply the provision of personal data.

Should the user choose to provide his/her personal data, CBT will handle such personal data on the basis of his/her consent, which may be withdrawn at any time, without calling into question the handling done prior to such consent being withdrawn.

The collection form will also have a field for the user to expressly mark his/her consent to the handling of his/her personal data for the purposes mentioned above.

CBT confirms that it does not create consumer profiles based on the personal data collected through the website.

Responsibility for personal data handling

In cases where personal data are communicated to CBT, this will be the entity responsible for the personal data collection and processing, while reserving the right to subcontract other entities to carry out such processing on behalf of and representing CBT. We guarantee that all entities subcontracted thereby to handle personal data on its behalf will be bound by contractual obligations with a view to preserving the confidentiality of the data and compliance with the legislation in force.

Information we obtain may be transferred between our group companies primarily in the Portugal as well as within & outside of the EEA.

Transfer to third parties and storage of personal data

If you are a candidate, we share your personal data with clients who have vacancies for jobs which you are interested in.

We also share your personal data and, when necessary, special category data with third party service providers who perform services and functions on our behalf, such as:

  • Conducting employment reference checks;
  • Conducting qualification checks;
  • Carrying out criminal convictions checks (as required);
  • Verifying details you have provided from third party sources;
  • Conducting psychometric evaluations or skills tests;
  • Hosting personal data for us;
  • Administering surveys or competitions on our behalf;
  • Assisting us to communicate with you; and
  • Providing research and mailing house or other direct marketing services.

We contractually require minimum standards of confidentiality and data protection from our third party service providers. If we need to send personal data outside the EEA, we will ensure that adequate safeguards are in place.

The user’s personal data will be kept in servers located within the European Union and no data transfers outside the European Union are contemplated.

Rights of the personal data subject

The user has the right to access, view, change, limit, rectify and delete his/her personal data communicated by him/her to CBT at any time, by sending an e-mail to privacy@cbtalents.com.

The user also has the right to withdraw his/her consent at any time (when the handling is based on that ground) and oppose the handling of his/her data for one or more purposes, as well as to request the transferability of his/her personal data.

No automated decisions are made affecting your personal data.

How to complain

We hope that our Data Protection Officer can resolve any query or concern you raise about our use of your information. If not, for further information about your rights and how to make a formal complaint, contact National Data Protection Commission (Comissão Nacional de Proteção de Dados – CNPD) at www.cnpd.pt.

Personal data storage period

We will keep your personal data for as long as we need to in order to fulfil the purpose we collected it for, which may be an ongoing purpose. For example, if you are a candidate, we will retain your personal data for the duration of our business relationship with you and beyond, as we often support candidates with job placements over many years and potentially throughout their careers.

We keep some personal data for longer than others. To determine the appropriate retention period for personal data, we consider factors such as the purposes for which we process your personal data, including any legal, regulatory, accounting and reporting obligations, the nature and amount of personal data that we hold about you, and the potential risk of harm to you from unauthorised use or disclosure of your personal data.

Where we have been unsuccessful in placing you in a temporary or permanent booking, we will retain your data for 3 years from the date we created your record in our database. If we have placed you, we will retain your information for 5 years from the date of placement or date on which you last worked for us.

We will retain certain pay-related and other financial information for 10 years in order to comply with our legal obligations.

Security measures

CBT is committed to ensuring that the security of personal data that is provided to us is protected. Bearing in mind the great concern and commitment that CBT shows in the defence of privacy matters, several technical and organizational security measures have been adopted in order to protect the personal data made available to us against its diffusion, loss, misuse, alteration, unauthorized handling or access, as well as any other form of illicit handling.

Notwithstanding the security measures adopted by CBT, we are obliged to alert all those who browse the Internet to adopt additional security measures, namely to ensure:

You use an updated PC and Browser in terms of properly configured security patches, with an active firewall, anti-virus and anti-spyware programs; and
The authenticity of the sites you visit on the Internet, while avoiding websites whose reputation you do not trust.

Changes to our privacy policy
